The taxman has the legal right to take this course of action without a court ruling, but a certain process has to be followed to keep inside the regulation. First of all, a letter will be sent to the taxpayer in arrears cautioning that distraint is about to begin. This may be followed by a visit to the debtor's residence or premises by a tax collector, so as to evaluate what resources and possessions that are worth something can be confiscated.
